We’re adults and know that despite the best of planning and good intentions, misunderstandings can and do sometimes arise. To minimise the chances of any misunderstanding, we’ve devised the following terms and conditions and would appreciate you familiarising yourself with them.

On placing a booking with us, both parties understand and accept that these terms and conditions have been read and agreed upon.

TOURS | TERMS AND CONDITIONS

Tour operator

Karoo Biking CC (KB), Loft 4, Five Howe Street, Observatory 7925, RSA

Tour booking form

With your signature on the booking form you accept these terms and conditions as a binding contract between KB and you, the participant. KB cannot accept any tour participant without a duly signed booking form. Please read the terms and conditions carefully.

Release and waiver

Every participant of a tour operated by KB is required to accept and sign a release and waiver form of rights before tour start. KB cannot accept any tour participant without a duly signed release and waiver form. A copy of the release and waiver forms can be provided by us.

Reservation and deposit

For the tour a booking deposit of 15% of the total tour price is required at the time of booking. This deposit secures a place on the tour. The balance is due 30 days before the tour starts. If the total balance is not received 30 days before tour start, KB reserves the right to treat this reservation as cancelled and charge the cancellation fee.

Motorcycle rental/safety deposit

Rental motorcycles are provided as part of the tour package. The type of motorcycle will depend on the booking you made. The pictures of the motorcycles on the website do not always represent the exact version of the motorcycles provided. KB reserves the right to substitute the motorcycle confirmed to tour participants. KB strives to ensure that all participants ride the motorcycle they are confirmed on and is very proud of their record of doing so. Unfortunately, at times, certain unexpected and uncontrollable situations arise which may require the substitution of a motorcycle. This includes, but is not limited to, mechanical failure, collision damage and theft. Should KB not be able to replace a confirmed motorcycle with the confirmed type or similar, a prorated refund for the difference in models will be refunded to participant. This constitutes the maximum liability of KB. A safety deposit has to be paid at the KB rental centre at the time of hand-over of the motorcycle at the beginning of the rental period. The amount of this safety deposit is equal to the amount of the deductible of the vehicle insurance. KB reserves the right to adjust the amount of this safety deposit and deductible without notice. This safety deposit will be refunded upon return of the undamaged motorcycle to KB. Some rental centres require a separate rental contract for the rental motorcycle to be signed at the rental station. The rental period is not interrupted due to the inability of a renter to ride or for any other reason. During the tour KB is not obliged to replace a damaged motorcycle.

Price of tour includes

The items included in the tour price are listed on other pages on our website. The tour price includes hotel accommodation in double, twin or single rooms.

Room allocation

A limited number of single rooms are available at extra cost on a first served basis, but availability cannot be guaranteed. KB will attempt to find a roommate for riders not specifying single room on their booking form.

Price of tour does not include

All items not mentioned as included and all items of a personal nature.

Baggage

KB assumes no responsibility for loss, damage or delay in delivering baggage to tour participants. Baggage turned over to KB for transport each day is done so at participant’s own risk. Baggage insurance is recommended.

Please note: A Trip cancellation insurance is not included in our tour prices.

Minimum tour participants

Up to 30 days prior to tour start, KB can cancel a tour, if an insufficient number of tour participants have booked and fully paid by that time.

Tour cancellation by KB

In this case the customers will be notified forth with. KB will offer to operate the tour if all customers agree to a supplemental charge due to the low number of tour members. If customers do not accept to pay the supplement, KB will refund their payment in full, which will constitute the full settlement. KB is not liable for any additional costs or losses incurred by the tour participant due to KB’s cancellation of tour due to lack of participation. This includes, but is not limited to, the cost of pre-paid airline tickets, hotel reservations and automobile rentals. Situations may rise which, in our opinion, make it necessary for us to cancel, advance or postpone a scheduled tour, change itineraries or make substitutions regarding hotels, cities and other travel arrangements. In that event, we do not assume responsibility or liability for any resulting losses, expenses or inconvenience. Your full tour price will be refunded if the tour is cancelled prior to scheduled tour start date. KB is not requ ired to make refunds once tour commences regardless of the reason for participant being unable to complete his or her tour.

Non-observance of traffic laws and group travel regulations

If the customer does not comply with traffic laws or the requirements for group travel, the contract may be cancelled by KB and the rental motorcycle secured.

Photo and video material

Photos and videos produced by KB or its representatives on tour are the property of KB. The copyrights rest with KB. KB can use all of this material for advertising and marketing purposes, including images in which individual tour members can be recognised, without any charge from the tour member arising for KB for this use of material.

Passport, Visa, driving and health regulations

The customer is responsible for complying with above regulations and all consequences resulting from non-compliance.

Responsibility

KB is responsible for providing the services listed in the tour description according to the local standard and the accurate description of services offered in its literature. KB carefully selects and constantly checks its contractors, such as hotels and restaurants. KB is responsible for conscientious travel preparations. KB is not responsible or liable for any accidents. KB reserves the right without prior notice to withdraw any part or all of a tour, to make such changes as may be necessary, and the extra cost, if applicable, resulting there from, shall be paid by the customer. Furthermore, it is agreed and understood that the owners, operators and agents of this tour including KB are not the guardians of any customer’s safety and they, individually or collectively, cannot be held liable in any way for any occurrence in connection with the operation or the client’s participation in connection with the tour, which might result in injury, death or other damage to the client, his property or his fami ly, heirs or assigns. KB is not responsible or liable for a delay occurring from the manufacturer’s failure to deliver the motorcycle on time. The liability of KB as the tour operator is limited to a total of three times the tour price irrespective of the title/claim. KB is not responsible for any delays changes in schedule or other conditions.

Alterations to tour schedule

Some tours operate on seasonal basis and where seasonable variances and/or weather conditions cause changes in the tour routing or accommodations, the itinerary will be adjusted accordingly and alternate hotels, restaurants and roads will be used.

Weather conditions

KB strives to schedule its tours at a time of the year when the weather in the touring area is usually pleasant for motorcycling. Many tours pass through areas where weather conditions can change very fast and significantly. KB cannot be made liable for unpleasant or unsuitable weather conditions and no refunds are made for such conditions.

Tour rates, rental rates and motorcycle costs

If cost factors including, but not limited to, hotels, meals, motorcycles, insurance, international currency fluctuations etc. dictate the need for fare increases, KB may do so at any time prior to 60 days before departure.

Verbal changes

Are invalid unless confirmed in writing by KB.

Printing errors and calculation mistakes

KB reserves the right to correct printing errors or calculation mistakes at any time.

Rental Tariffs

All of them can be fitted with luggage. KB reserves the right to substitute the motorcycle confirmed to the lessee. Insurance

Collision damage waiver and theft protection insurance are included in the price. An excess (or self-payment/deductable) per claim is required. The deposit is to be paid by credit card authorization on departure of rental, and withheld until the motorcycle is cleaned and inspected upon return. Please check our current rate card for the actual damage deposit amount, which varies according to the motorcycle model chosen.

Lessee Responsibilities

It is the lessee’s responsibility to handle the rented motorcycle with care and to adhere to local rules and regulations. Using the motorcycle to trespass is prohibited. The lessee is to report any damage to the motorcycle in the case of an accident, immediately.

a. Detailed information about the exact damage claim procedure as well as all information for parties involved in an accident can be provided on request.

b. The lessee is liable for a self or excess payment (both in full and/ or in part) to the value of the deposit paid on receipt of the motorcycle, so long as the accident was not caused due to major negligence on the part of the lessee.

The motorcycle may not be used by anyone other than the lessee. The lessee is to return the motorcycle in the same condition and with the same tank level as when receipt of the motorcycle was taken.

Cross-border Rentals

Under no circumstances may a Karoo Biking motorcycle leave the borders of the Republic of South Africa without our permission. If you plan to visit a neighboring country with a Karoo Biking motorcycle, please contact our offices well ahead of your rental commencing.

Terms of Payment

A deposit of 25% of the motorcycle rental needs to be paid at the time the reservation is made, the balance is due 30 days prior to the collection of the motorcycle. The insurance excess to be paid by credit card authorisation on departure of rental, and withheld until the motorcycle is cleaned and inspected upon return. We endeavour to release the deposit within 48 hours after the bike was returned.
